Premise Liability
The most common
Premise Liability claims are what is known as 'slip and fall' accidents.
Owners of personal and
commercial/business properties owe a duty to ensure that their property is
properly serviced and maintained, and free from dangerous hidden conditions.
You must preserve evidence and
pursue a claim as soon as possible.
Premise liability claims
require injury to a person while on the owner's property due to a hidden or
latent defect which should have been corrected by the property owner.
Generally, if the defect is open and obvious, there can be no recovery.
Even if the danger is open and
obvious and the owner of the property is not negligent, you should still try to
find out if the property owner maintained a medical payments policy which may
cover a portion of your necessary medical expenses.
